Privacy policy

§ 1 General provisions
 
  1. This Privacy Policy sets out the rules for the processing and protection of personal data provided by Customers (hereinafter also "Users") in connection with their use of the Services via the www.erotic4.com shop
  2. The terms used in the Regulations have the same meaning in this Privacy Policy.
  3. The Service Provider makes every effort to ensure respect for privacy and protection of personal information provided by Users when using the Shop and takes all necessary actions for this purpose.
 
§ 2 Personal Data Administrator

The administrator of Users' personal data provided in connection with their use of the Services via the Shop (hereinafter: "Personal Data") is the Service Provider, i.e.

§ 3 Rules for collecting Customers' Personal Data
 
  1. Browsing the content of the Store does not require the User to provide Personal Data.
  2. Registration of a User Account, and thus access to more functionality of the Store, requires the User to provide Personal Data.
  3. Purchases without registration via the Store require the provision of Personal Data.
  4. Failure to provide Personal Data by the User will not allow Registration.
  5. Users' personal data is processed in the following scope:

    1. providing the service of maintaining the User's account and all related services in the Store - the legal basis for data processing is the performance of the contract (Article 6 (1) (b) of the GDPR);
    2. execution of the purchase and sale contract- the legal basis for data processing is the execution of the contract (Article 6 (1) (b) of the GDPR);
    3. marketing - the legal basis for data processing is the legitimate interest of the Store - marketing of own products and services (Article 6 (1) (f) of the GDPR);
    4. consideration of complaints, investigation and defense in the event of mutual claims - the legal basis for data processing is the legitimate interest of the Store - (Article 6 (1) (f) of the GDPR);
    5. sending commercial information electronically - only in the case of consent by the User - the legal basis for data processing is consent (Article 6 (1) (b) of the GDPR);

  6. Browsing the Store does not require providing personal data, but may involve the use of Cookies, depending on the settings made by the User.
  7. Providing personal data by the User is a condition for the supply of Services within the Store, excluding browsing its content. You are obliged to provide the personal data and the consequence of not providing it will be the inability to supply Services as part of the Online Store.
  8. Users' personal data may be processed in an automated manner, including in the form of profiling, provided that the User has consented to it. Automated decision-making will be based on the analysis of the User's traffic in the Store in order to personalize the content and advertisements provided, and to analyze traffic on our websites. The consequence of such processing will be a better matching of the content of the Store's pages to the User, including the displayed advertisements, materials or recommendations to the User's preferences or interests.
 
§ 4 Scope of processing Personal Data and the period of their processing
 
  1. The Administrator will ask the User to provide the following Personal Data, which the User should provide for Registration:

    1. First name and last name,
    2. address,
    3. e-mail address,
    4. other data provided by the User in the registration form or the purchase form via the Store.

  2. The Service Provider also collects User's IP address for statistical purposes and for more efficient solving of reported problems.
  3. User's personal data will be stored for the period of providing the Services, unless the law provides for a longer period of their processing.
 
§ 5 User's rights
 
  1. Each User has the right to access their data and the right to rectify, delete, limit processing, the right to transfer data, the right to raise objections, the right to withdraw consent at any time without affecting the lawfulness of processing, which was made on the basis of consent before withdrawal of consent.
  2. Each User has the right to lodge a complaint with the President of the Personal Data Protection Office, when they consider that the processing of their personal data violates the provisions of the General Data Protection Regulation of 27 April 2016.
 
§ 6 Commercial information

  1. The Administrator may send Users, including to the e-mail addresses provided by them, commercial information about the Administrator's products and services and other products and services, under the condition the User has agreed to receive them. The user may revoke consent at any time.
 
§ 7 The use of cookies

  1. "Cookies" are text files saved by the browser on the User's computer disk in order to store information used to identify the User or remember the history of actions taken by him.
  2. The store uses technologies such as cookies, local storage and similar to collect and process personal data and operational data in order to personalize the content and advertisements provided and to analyze website traffic. Cookies are IT data saved in files and stored on your end device (i.e. your computer, tablet, smartphone, etc.), which the browser sends to the server each time you visit the website from this device, while you visit various websites on the Internet.
  3. By using the Store, by properly configuring your browser settings, you consent to the use of Cookies and other similar technologies in accordance with this Privacy Policy. If you do not agree to our use of Cookies or other similar technologies, you should change your browser settings or resign of using  Store services.
  4. „Cookies” are used to:

    1. identifying the User and correctly assigning him historical data collected during previous visits to the Administrator's Store,
    2. better matching the content and advertisements available to the User's expectations and interests,
    3. maintaining the Customer's session (after logging in), thanks to which the Customer does not have to re-enter the Password on each subpage of the Store,
    4. to make it easier for the Administrator to present the Internet User with advertisements tailored to the User's interests,
    5. optimizing the use of the Store,
    6. adapting the Store to the needs of Users,
    7. creating statistics of the Shop's subpages.

  5. The user may refuse to place "cookies" on his computer, e.g. using his browser settings.
  6. In the Help section of browsers, you can find instructions on how to disable the saving of "Cookies" by the browser.
 
§ 8 Security
 
  1. Connection during filling forms are made via a secure encrypted connection.
  2. However, it is recommended to follow the safety rules yourself. In particular, you should keep your login and password confidential and do not disclose them to third parties.
  3. Please remember that the Publisher will not ask for them, except for providing them when logging into the User Account. In order to prevent the use of the User Account by unauthorized persons, please log out after using the Store.
 
 
§ 9 Transfer and Sharing of Personal Data

  1. The Administrator may transfer or share Personal Data to third parties if in the above cases: 

    1. The user agrees to this or
    2. it will be justified by law or
    3. it will be necessary for the provision and performance of the contract.

  2. In above cases Personal Data will be transferred on the basis of a contract for entrusting the processing of personal data, unless the law excludes such an obligation. Entrusting the processing of Personal Data in the situation described in the first sentence will ensure the protection of Personal Data in accordance with the Personal Data Protection Act at a level at least the same as the security measures used by the Administrator.
  3. The data may be entrusted to the following categories of recipients of personal data:
  • entities providing services to the Administrator, including accounting and legal services;
  • software providers;
  • advertising providers, including using such partners' software;
  • intermediaries in transactions, including payment services;
  • transport companies ensuring the delivery of the purchased Goods.
 
 
§ 10 User's Rights
 
  1. The Administrator provides the User with the option of removing his Personal Data from the Data Set at his request, as well as in other cases, on the basis of applicable law.
  2. The Administrator may refuse to delete Personal Data if the User has not settled all amounts due to the Administrator or has violated the Regulations or applicable law, and the maintaining Personal Data is necessary to determine the User's liability.
  3. Each User has the ability to view and edit their Personal Data at any time, as part of the functionality of the Store, after logging in using their e-mail address and password.
